This Privacy Policy is designed to assist you in making informed decisions when using the Services and should be reviewed in addition to XLPrint’s Terms of Service and End User License Agreement (collectively, “End User Agreements”).

Your Consent

By visiting and using the Services, you consent to our collection and use of your personal information as described in this Privacy Policy. Please read this Privacy Policy in its entirety. We reserve the right to modify, alter, or otherwise update this Privacy Policy at any time to address changing legal obligations, technologies, business practices, and our users’ needs. We encourage you to check back periodically so that you are always aware of the most current policies and practices that XLPrint has in place to protect your information.

What Information Do We Collect?

When you visit the Services, you may provide us with two types of information: 

  1. Personal information you knowingly choose to disclose that is collected on an individual basis, and 
  2. Website and Services Application use information.
  1. Personal Information you Choose to Provide

When you purchase any Services from us or correspond with us via email, online chat, the Services, written mail, or phone, you may need to give personal information necessary for us to provide you with the requested Services. For example, you may need to provide the following information :

  1. Contact Information, such as first name, last name, email address, company name, phone number, and mailing address;
  2. Unique Identifiers, such as a username or password;

Website Use Information and Use-Tracking Devices

We automatically collect Website usage information from you when you visit our Services (collectively “Technical Information”).Similar to other commercial websites, our Services may use “web beacons,” webserver logs, and Web Traffic Analytic Services to collect information about how our Services are used. The information gathered may include your computer or device’s internet protocol (IP) address, the date and time of your visits, and your page views. We collect specific data about the use of our Services, including the pages accessed by the user and when they are accessed. This information is collected to ensure compliance with XLPrint’s End User Agreements, to assist us in offering you Services, and to allow you to customize your use of the Services. We may collect information about specific searches with the intention of identifying what features of the Services are frequently accessed but will not correlate this information to a specific individual. This ensures we can continue to develop our Services to meet the needs of our users. In addition, we may track the Services visited by an individual just before our Service and/or links to external websites referenced in our Services to better understand our users’ interests. The usage information we collect may be compiled into aggregated usage information to manage and improve the Services.

Our Services respond to “do not track” signals or similar mechanisms that may be provided by web browsers or otherwise.  We may also permit third parties to collect aggregate usage information regarding your activities on our Services, and those third parties may also not respond to “do not track” signals.

How Do We Use the Information That You Provide to Us?

Broadly speaking, we use personal information to administer our business activities, provide customer service, and make available other Services to our customers and prospective customers. Our uses of personal information may include the following:

  1. To enable us to process, validate, verify and deliver Services that you have ordered;
  2. To allow us or you to personalize the Services that you obtain based on personal characteristics or preferences;
  3. To provide notices to you about important changes to the Services;
  4. To provide information about new or existing Services or special offers from us we believe will be of interest to you or otherwise to contact you;
  5. To improve XLPrint’s Services;
  6. To monitor your compliance with the XLPrint End User Agreement (For example, we automatically collect IP address information from you when you visit our Services, and we may use this information to monitor your compliance with our Terms and Agreements); and
  7. To comply with the law.

Do We Disclose Information to Third Parties?

XLPrint only shares personal information with third parties in the following limited circumstances:  

  1. We have your consent for a specific purpose, such as to process a transaction or complete a request using the Services.
  2. We provide such information to our business partners or entities to perform services on our behalf. These entities will only collect, use, and disclose your personal information to the extent necessary to allow them to perform the services they provide to us. These entities will employ commercially reasonable security procedures and practices to protect your personal information from unauthorized access, destruction, use, modification, or disclosure.
  3. Certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies for the information we are required to provide to them for your online transactions. For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled. In particular, remember that certain providers may be located in, or have facilities that are located in, a different jurisdiction than either you or us.   4. If XLPrint becomes involved in a merger, acquisition, or any form of sale of a substantial portion of its assets, your information may be provided to a third party as part of such sale. We will provide notice before your personal information is transferred and becomes subject to a different privacy policy.
  5. We have a good faith belief that access, use, preservation, or disclosure of such information is reasonably necessary to (a) satisfy any applicable law, regulation, legal process or enforceable governmental request, (b) enforce the terms or conditions of the XLPrint End User Agreement including investigation of potential violations thereof, (c) detect, prevent, or otherwise address fraud, security or technical issues, or (d) protect against imminent harm to the rights, property or safety of XLPrint, its customers or the public as required or permitted by applicable law.

Your personal information is not otherwise sold or traded or distributed outside of XLPrint.

Certain jurisdictions, most notably those subject to the United Kingdom’s Data Protection Act (“DPA”) and the European Union’s General Data Protection Regulation (“GDPR”), require that there be a lawful basis to process personal data.  We have set out below, in a table format, a description of all the ways we plan to use your personal data, and which of the legal basis we rely on to do so for those jurisdictions that require a legal basis. We have also identified what our legitimate interests are where appropriate.

Note that in those jurisdictions that require a legal basis in order to process your personal information, we may process your personal data for more than one lawful ground depending on the specific purpose for which we are using your data. By using the Services you hereby understand, acknowledge, and consent to the transfer of information outside of the United States.

How Do We Secure Information Transmissions?

Emails that you may send to us may not be secure unless we advise you that security measures will be in place prior to your transmitting the information. For that reason, we ask that you do not send confidential information such as credit card account numbers to us through an unsecured email.

If you provide us with your credit card information through our online store, this transaction information is encrypted using secure socket layer technology (SSL) and stored with AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

How Do We Protect Your Information?

Information Security. Personal information and user-specific settings and preferences are stored using commercially standard database and website security software. User passwords and other sensitive user information are saved in encrypted form to prevent unauthorized access or disclosure and accidental loss, alteration, or destruction.

Evaluation of Information Protection Practices. Periodically, our operations and business practices are reviewed for compliance with corporate policies and procedures governing the security, confidentiality, and quality of our information.

Employee Access, Training and Expectations. Our employees are required to protect confidential information in general as a condition of employment at XLPrint, and our business practices limit the use and disclosure of such information, including personal information, to authorized persons, processes, and transactions.

Providing, Correcting and Updating your Information

When you order a Service, we may ask you to provide personal and/or business information. If you decline to submit this personal information, XLPrint may not be able to provide those Services to you. This personal information will be used only for the purposes described in this Privacy Policy unless we have obtained your prior consent.

To process your requests, we may ask you to provide such identification as we deem necessary to protect your personal information from unauthorized access. Also, we may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort, jeopardize the privacy of others, or would be extremely impractical(for example, requests concerning information residing on backup tapes), or for which access is not otherwise required.

In any case where we provide information access and correction, we will perform this service free of charge during normal business hours, except if doing so would require a disproportionate effort. Your California Privacy Rights/California Shine the Light Law

If you are a resident of California, you have the right to request once a year that we disclose to you the types of personal information that we have shared with third parties for direct marketing purposes during the past year and the identities of the third parties with which we shared this information. To make such a request, please contact us using the information above. XLPrint will respond within 30 days.

Severance and Waiver:

You understand, acknowledge, and agree that if any provision of this Privacy Policy shall be found to be unlawful, void, or for any reason unenforceable by a court of competent jurisdiction, then that provision shall be deemed severable from this Privacy Policy and shall not affect the validity and enforceability of any remaining provisions. You further understand, acknowledge, and agree that, if any provision of this Privacy Policy is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision.

XLPrint’s failure to exercise or enforce any right or provision of this Privacy Policy shall not constitute a waiver of such right or provision unless acknowledged and agreed to by XLPrint.

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

International Users

Please note that the Services generally are directed towards users in the United States, United Kingdom and Australia. By using the Services, you acknowledge the personal data XLPrint processes, and all associated Services are housed on servers located in the United States or United Kingdom, and you consent to the collection, storage, processing, and transfer of your information in and to the United States, United Kingdom, Australia, or other countries and territories, pursuant to the laws of the Australia. While some of these countries may not offer the same level of privacy protections as your own, we commit to upload the privacy protections as explained in this Privacy Policy.

For individuals in the UK or EEA, where we transfer your personal data out of the UK or EEA, we ensure that your data is afforded a similar degree of protection by using specific contracts approved by the European Commission (known as the Standard Contractual Clauses).
